Get Hooked! - Terms of Use

1. Acceptance of Terms

By accessing or using Get Hooked!, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

2. Description of Service

Get Hooked! is a fishing waypoint management and forecast application that allows users to:

• Import and manage GPX files containing waypoints
• Add custom metadata to fishing locations (gear, depth, bait, etc.)
• Access AI-powered fishing forecasts based on weather data, river flow rates, and historical success
• View historical satellite data (NASA MODIS) showing water temperature, turbidity, and chlorophyll trends
• Monitor real-time river flow data from USGS monitoring stations
• Set custom river flow alerts for optimal fishing conditions
• Analyze solunar bite windows with hourly feeding period predictions
• Visualize fishing hotspots with heat map overlays
• Receive intelligent notifications about dangerous conditions, optimal pressure, river flow changes, and daily forecasts
• Share GPX files via Messages, AirDrop, email, and other platforms
• Back up data to their personal iCloud account (optional)
• Customize scoring weights for fishing forecasts

3. Subscription Service

3.1 Subscription Tiers

Get Hooked! offers two subscription tiers with different feature limits:

Subscriptions automatically renew yearly unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your iPhone Settings under your Apple ID → Subscriptions.

3.2 Payment and Billing

• Subscriptions are purchased through Apple In-App Purchase
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions in your App Store account settings at any time

3.3 Cancellation

• You may cancel your subscription at any time through iOS Settings → Subscriptions
• Cancellation takes effect at the end of the current billing period
• No refunds or credits for partial billing periods
• Access to Pro features continues until the end of the paid period

3.4 Free Trial

• Free trials may be offered at our discretion
• Trial periods and terms will be clearly disclosed before purchase
• Cancel before trial ends to avoid charges

4. Refund Policy

All purchases are processed through Apple's App Store. Refund requests must be submitted to Apple according to their refund policies:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Select Get Hooked! purchase and request refund
• Apple will review and respond within a few days

We cannot process refunds directly as all transactions are handled by Apple.

5. User Accounts and Data

5.1 No Account Required

Get Hooked! does not require you to create an account. All data is stored locally on your device and optionally in your personal iCloud account.

5.2 Data Ownership

• You retain full ownership of all waypoint data, GPX files, and metadata you create or import
• Your data is stored locally on your device
• Optional iCloud backups are stored in YOUR iCloud account, not our servers
• We have no access to your waypoint locations, river favorites, or fishing data
• You control all sharing: When you export GPX files, you choose recipients and sharing methods

5.3 Data Security

You are responsible for:

• Maintaining the security of your device
• Backing up your data (via iCloud or export)
• Protecting your Apple ID credentials
• Controlling who you share GPX files with
• Managing notification permissions and settings

6. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices in the App
• Use the App to harass, abuse, or harm others
• Interfere with or disrupt the App's operation
• Attempt to gain unauthorized access to any portion of the App
• Use automated systems or bots to access the App
• Violate any fishing regulations or laws in your jurisdiction
• Abuse API rate limits or attempt to overwhelm third-party services (weather, USGS, satellite)
• Share GPX files containing waypoints on protected or restricted waters without proper authorization
• Use the sharing feature to distribute malicious files or spam

7. Weather Data, Forecasts, River Flow Data, Satellite Data, and Solunar Predictions

7.1 Third-Party Data

Weather data is provided by Visual Crossing Weather API, tide data by NOAA Tides & Currents, river flow data by USGS Water Services, satellite data by NASA MODIS via NOAA ERDDAP, and solunar calculations are based on astronomical algorithms. We are not responsible for the accuracy, completeness, or timeliness of this third-party data or calculated predictions.

7.2 No Guarantee of Accuracy

Fishing forecasts, historical satellite data, river flow predictions, solunar bite windows, and heat map visualizations are predictions and analyses based on weather patterns, river conditions, satellite imagery, astronomical calculations, and historical data. We do not guarantee:

• Accuracy of forecasts, satellite data, river flow data, or solunar predictions
• Fishing success at any location or during predicted bite windows
• Safety of conditions described
• Availability of satellite data or river stations for all locations
• Accuracy of USGS river flow measurements or predictions
• Timeliness of river flow data updates
• Accuracy of solunar feeding period timing
• Correlation between solunar periods and actual fish activity
• Heat map accuracy in identifying productive fishing areas

7.3 Satellite Data Limitations

Historical satellite data from NASA MODIS:

• May not be available for all water bodies (especially small lakes and narrow rivers)
• Can have gaps due to cloud cover or sensor limitations
• Provides regional analysis (~1km resolution), not pinpoint accuracy
• Is for informational purposes only
• Should not be relied upon as the sole basis for fishing decisions

7.4 River Flow Data Limitations

River flow data from USGS monitoring stations:

• May not be available for all rivers or river sections
• Update frequency varies by station (typically 15-60 minutes)
• Can have gaps or errors due to equipment malfunctions
• Represents flow at the monitoring station only, not the entire river
• Does not account for sudden changes from upstream rainfall or dam releases
• Should not be relied upon as the sole basis for safety decisions
• Does not predict fish locations or behavior

7.5 Solunar Theory Limitations

Solunar bite window forecasts are based on astronomical calculations and fishing theory:

• Solunar theory is not scientifically proven to guarantee fish activity
• Many factors affect fish behavior beyond moon and sun positions
• Predicted feeding periods may not align with actual fish activity
• Should be used as one of many factors in fishing trip planning
• Major and minor periods are timing windows, not guarantees of success
• Local conditions (weather, water clarity, river flow, fishing pressure) override solunar predictions

7.6 Heat Map Limitations

Heat map visualizations show waypoint density and historical activity:

• Do not predict future fish locations or behavior
• High-density areas may represent unsuccessful attempts, not productive spots
• Fish movement patterns change seasonally and with conditions
• Should be combined with current environmental data (weather, river flow, temperature)
• Are based solely on YOUR historical data, not actual fish populations

8. Safety Disclaimer

The App provides informational forecasts, river flow data, and notifications. It is NOT:

• A substitute for official weather warnings or emergency alerts
• A guarantee of safe conditions
• A replacement for your own judgment and assessment
• A real-time monitoring system for rapidly changing conditions
• A flood warning system

9. Modifications to the App

We reserve the right to:

• Modify, update, or discontinue any feature of the App
• Change subscription pricing with 30 days notice
• Update these Terms at any time (with notice of material changes)
• Terminate the App entirely (with reasonable notice)
• Adjust notification frequency or types
• Modify solunar calculation methods
• Update heat map algorithms
• Add or remove USGS river monitoring stations

Continued use after modifications constitutes acceptance of the changes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

10.1 App Provided "AS IS"

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of forecasts, satellite data, river flow data, solunar predictions, heat maps, or weather information
• Timeliness or reliability of notifications
• Uninterrupted or error-free operation
• Availability of satellite data or river monitoring stations for specific locations
• Accuracy of bite window calculations
• Successful delivery of dangerous condition alerts or river flow alerts

10.2 No Liability for Damages

We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Use or inability to use the App
• Reliance on forecasts, weather data, river flow data, satellite data, solunar predictions, heat maps, or notifications
• Inaccurate or incomplete satellite data, river flow data, or solunar calculations
• Data loss or corruption
• Personal injury or property damage resulting from use of the App
• Fishing trips, accidents, or incidents
• Failure to receive dangerous condition notifications or river flow alerts
• Fishing during predicted bite windows without success
• Following heat map suggestions to unproductive areas
• Shared GPX files being misused by recipients
• Unauthorized access to your device or data
• Third-party actions or services
• Failure of third-party APIs (NOAA, NASA, USGS, Visual Crossing)
• River flooding or dangerous flow conditions

10.3 Maximum Liability

Our total liability for any claims related to the App shall not exceed the amount you paid for the subscription in the 12 months preceding the claim ($29.99 maximum for Pro tier).

11. Indemnification

You agree to indemnify and hold harmless Hooked on Yutz and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of others
• Your fishing activities
• Any content you create or import
• Your reliance on forecasts, satellite data, river flow data, solunar predictions, heat maps, or notifications
• Your sharing of GPX files with third parties
• Recipients' use of GPX files you shared
• Fishing during dangerous conditions despite receiving notifications
• Entering rivers during high or dangerous flow conditions

12. Disclaimer of Fishing Success

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING:

• The accuracy of fishing forecasts, satellite data, river flow data, solunar bite windows, or heat map hotspots
• The likelihood of catching fish
• The safety or accessibility of any location
• Fishing regulations or licensing requirements in your area
• The condition of any body of water
• The availability or reliability of satellite data or river monitoring stations for your fishing locations
• Accuracy of predicted feeding periods
• Fish activity during major or minor solunar periods
• The productivity of areas shown as "hot" on heat maps
• The delivery or accuracy of notifications
• Optimal river flow ranges for fishing success

Fishing success depends on numerous factors beyond our control, including but not limited to: skill, equipment, bait selection, fish behavior, weather, seasons, water conditions, river flow, fishing pressure, actual fish feeding patterns, and luck.

13. Privacy

Your use of the App is also governed by our Privacy Policy, available at hookedonyutz.com/get-hooked-app-privacy-policy. By using the App, you consent to the data practices described in the Privacy Policy.

Sharing Privacy: When you share GPX files via Messages, AirDrop, email, or cloud storage, you are using third-party services subject to their own privacy policies. We are not responsible for the privacy practices of these services or how recipients use your shared data.

14. Geographic Restrictions

The App is available worldwide but:

• Weather data availability varies by location
• Tide data is limited to NOAA-supported regions
• River flow data is limited to USGS-monitored rivers (primarily United States)
• Satellite data availability varies by water body and location
• Solunar calculations adapt to your timezone but may be less accurate near the poles
• Some features may not work in all countries
• You are responsible for complying with local laws and regulations
• Notification delivery depends on local cellular/WiFi availability

15. Children's Use

The App is not intended for children under 13 years of age. We do not knowingly collect information from children under 13. If you are under 13, do not use the App. Parents should supervise use by children under 18.

16. Apple-Specific Terms

16.1 App Store Terms

Your use of the App is also subject to Apple's App Store Terms of Service and Apple Media Services Terms and Conditions.

16.2 Device Requirements

You must have a compatible iOS device (iOS 15.0 or later) and internet access for full functionality.

Feature Requirements:

• Notifications require iOS notification permissions and background refresh enabled
• Heat maps require location services for accurate coordinate processing
• Solunar calculations require accurate device time and timezone settings
• River flow data requires internet connectivity
• Sharing requires iOS sharing permissions and access to Messages, Mail, or Files

16.3 Apple Not Responsible

Apple is not responsible for the App, its content, maintenance, support services, or warranty. Any claims related to the App should be directed to us, not Apple.

17. Dispute Resolution

17.1 Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.

17.2 Informal Resolution

Before filing any formal claim, you agree to contact us at admin@hookedonyutz.com to attempt to resolve the dispute informally.

17.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, with the arbitration taking place in Ohio.

17.4 Class Action Waiver

You agree to bring claims only in your individual capacity and not as part of any class action or representative proceeding.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hooked on Yutz regarding the App and supersede all prior agreements.
