Get Hooked! - Terms of Use (Android)

These Terms of Use ("Terms") govern your use of the Get Hooked! mobile application ("App") on Android devices. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Get Hooked!, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. License Grant

Subject to your compliance with these Terms, Hooked on Yutz grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on Android devices that you own or control.

You may NOT:

Copy, modify, or create derivative works based on the App
Distribute, transfer, sublicense, lease, lend, or rent the App to any third party
Reverse engineer, decompile, or disassemble the App
Remove, alter, or obscure any proprietary notices on the App
Use the App for any commercial purpose without our prior written consent

3. User Content and Data

Your Fishing Data

All waypoints, catches, GPX files, forecasts, and other data you create or upload to the App ("User Content") remain your property. The App stores this data locally on your device and optionally in your personal Google Drive account if you enable backup.

Our Rights

We do not claim ownership of your User Content. However, you grant us a limited license to use anonymous, aggregated usage data for analytics and app improvement as described in our Privacy Policy.

Responsibility for Your Data

You are solely responsible for backing up your User Content. While we provide optional Google Drive backup functionality, we are not responsible for any loss of data.

4. Subscription Terms

Free and Pro Tiers

Get Hooked! offers both a free tier with limited features and a Pro subscription tier with unlimited features. Subscription fees and features are detailed in the App and on our website.

Billing and Cancellation

Subscriptions are billed through Google Play Billing
Pro subscriptions renew automatically unless canceled at least 24 hours before the current period ends
You can cancel at any time through Google Play Store → Subscriptions
Cancellations take effect at the end of the current billing period
No refunds for partial subscription periods
All billing matters are handled by Google Play, not by Hooked on Yutz

Price Changes

We may change subscription prices at any time. Price changes will not affect your current subscription period but will apply to renewals. You will be notified of price changes before they take effect.

5. Third-Party Data and Services

The App integrates data from third-party sources including:

NOAA (National Oceanic and Atmospheric Administration)
USGS (United States Geological Survey)
NASA (National Aeronautics and Space Administration)
Environment Canada
Visual Crossing Weather API
OpenStreetMap
Google Maps

We are not responsible for the accuracy, availability, or reliability of third-party data. These services have their own terms of use and privacy policies.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

The App will be uninterrupted, secure, or error-free
Fishing forecasts or predictions will be accurate
River flow data, weather data, or satellite imagery will be current or reliable
The App will meet your specific fishing needs
Any defects will be corrected

Fishing Safety Disclaimer

IMPORTANT: Get Hooked! provides informational tools only. You are solely responsible for:

Assessing weather and water conditions before fishing
Making safe decisions about when and where to fish
Following all applicable fishing regulations and laws
Ensuring your own safety on the water

Never rely solely on the App for safety decisions. Always check official weather forecasts, river gauges, and marine conditions before going on the water.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOOKED ON YUTZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the App
Any inaccuracy in fishing forecasts, river flow data, weather data, or satellite imagery
Any loss of waypoints, catches, or other User Content
Any unauthorized access to your device or data
Any interruption or cessation of the App

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS LESS.

8. Indemnification

You agree to indemnify and hold harmless Hooked on Yutz, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another person or entity
Your fishing activities or decisions made based on App data

9. Updates and Changes to the App

We may update the App from time to time to:

Add new features
Fix bugs or security issues
Improve performance
Comply with legal requirements

You are responsible for maintaining a compatible Android device and operating system version. We may discontinue support for older OS versions at any time.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may stop using the App at any time by uninstalling it from your device.

Upon termination:

Your license to use the App terminates immediately
You must delete all copies of the App from your devices
Your User Content stored locally on your device remains yours
Active subscriptions continue until the end of the current billing period

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Erie County, Ohio, except that either party may seek injunctive relief in any court of competent jurisdiction.

12. Changes to These Terms

We may modify these Terms at any time. When we make changes:

The "Last Updated" date will be revised
We will notify you through the App or Google Play Store update notes
Continued use of the App constitutes acceptance of the modified Terms

If you do not agree to the modified Terms, stop using the App and uninstall it from your device.

13. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hooked on Yutz regarding the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Hooked on Yutz.
