Terms of Use

These Terms of Use ("Terms") govern your use of the Get Chalked mobile application ("App") provided by Hooked on Yutz ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. License Grant

Hooked on Yutz grants you a limited, non-exclusive, non-transferable, revocable license to use the Get Chalked application for personal, non-commercial purposes, subject to these Terms.

This license does not include the right to:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Remove any proprietary notices or labels
• Use the App for any commercial purpose without written permission

2. Purchases & Payments

The App is available for purchase through the Apple App Store and Google Play Store. All purchases are processed by Apple or Google, not by us.

Pricing: $17.99 per year for all features. Prices are subject to change.

Refunds: We do not process refunds directly. All refund requests must go through Apple or Google per their respective policies.

Subscription Terms: Annual subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

3. Score Data

The App displays gymnastics scores aggregated from publicly available sources. This data consists of facts (scores, dates, names) that are not copyrightable.

Accuracy: We strive for accuracy but cannot guarantee it. Scores depend on meet directors uploading data correctly. We are not responsible for errors, omissions, or delays.

Availability: Score availability depends on third-party sources. We cannot guarantee that scores for every meet or athlete will be available.

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App's operation
• Use automated systems (bots, scrapers) to access the App
• Circumvent any security features
• Use the App to harass, stalk, or harm any person

5. Intellectual Property

The App, including its design, code, graphics, and features (but excluding publicly available factual score data), is owned by Hooked on Yutz and protected by intellectual property laws.

The "Get Chalked" name, logo, and branding are trademarks of Hooked on Yutz.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle information.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

• The App will be uninterrupted or error-free
• Score data will be accurate or complete
• The App will meet your specific requirements
• Any errors will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOKED ON YUTZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or related to your use of the App, including but not limited to:

• Loss of data or profits
• Errors or omissions in score data
• Service interruptions
• Any actions taken based on information in the App

Our total liability for any claim shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Hooked on Yutz and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

11. Dispute Resolution

Arbitration Agreement: Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association, rather than in court.

Class Action Waiver: You agree to resolve disputes only on an individual basis and waive any right to participate in class actions.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to info@hookedonyutz.com within 30 days of first using the App.

12. General

Governing Law: These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hooked on Yutz regarding the App.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

Changes: We may modify these Terms at any time. Continued use after changes constitutes acceptance.
