These Terms of Use ("Terms") govern your use of the Get Pudding! mobile application ("App") provided by Hooked on Yutz ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Get Pudding!, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Get Pudding! is a retro-style bomber game inspired by the VIC-20 era. Players fly a plane across the screen, drop bombs to clear a mountain, and collect gold while avoiding hazards. The game is a single-purchase entertainment application with no in-app purchases or advertisements.

3. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to transmit harmful code or malware

4. User Content

Any data generated by the App (high scores, game settings, unlocked features) is stored locally on your device. We do not access, collect, or store any user data on external servers.

5. Purchase and Payment

Get Pudding! is a one-time purchase application available through the Apple App Store. The purchase includes:

• Full access to all game features
• All unlockable content (Gas Pockets, Bedrock)
• No advertisements
• No additional in-app purchases

All purchases are processed through the Apple App Store and are subject to Apple's terms and refund policies.

6. Intellectual Property

The App and its original content, features, gameplay mechanics, and visual design are owned by Hooked on Yutz and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

7. Third-Party Services

The App uses third-party services:

• Apple App Store for distribution and payments

Your use of these services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• The App will be compatible with all devices
• Game performance will be identical across all supported devices

The App is designed for entertainment purposes only.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Loss of data (high scores, settings)
• Device compatibility issues
• Interruption of gameplay

Our total liability shall not exceed the amount you paid for the App.

10. Indemnification

You agree to indemnify and hold harmless Hooked on Yutz from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms within the App or on our website. Your continued use of the App after changes constitutes acceptance of the updated Terms.

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.
