Terms of Use

These Terms of Use ("Terms") govern your use of the Get Gone mobile application ("App") provided by Hooked on Yutz ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Get Gone, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Get Gone is a PTO optimization tool that helps users plan their time off by analyzing holidays, weekends, and user-provided constraints. The App provides suggestions for when to take PTO to maximize total days off.

3. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to transmit harmful code or malware

4. User Content

Any data you enter into the App (settings, constraints) is stored locally on your device. You are responsible for the accuracy of the information you provide. We do not access, collect, or store your personal constraint data on our servers.

5. In-App Purchases

Get Gone offers optional in-app purchases ("Get Gone Pro") that unlock additional features. All purchases are processed through Apple's App Store or Google Play Store and are subject to their respective terms and refund policies.

• Purchases are non-refundable except as required by applicable law or the policies of Apple or Google
• You can restore purchases on any device signed into the same Apple ID or Google account

6. Intellectual Property

The App and its original content, features, and functionality are owned by Hooked on Yutz and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

7. Third-Party Services

The App uses third-party services:

• Nager.Date API for public holiday data
• Firebase for anonymous analytics and crash reporting
• Apple App Store / Google Play for distribution and payments

Your use of these services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• The optimization results will meet your specific needs
• Holiday data will be accurate or complete for all regions

The App provides suggestions for planning purposes only. You are responsible for verifying dates with your employer and making your own PTO decisions.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Loss of data
• Loss of profits
• Missed vacation opportunities
• Errors in optimization results

Our total liability shall not exceed the amount you paid for the App or in-app purchases.

10. Indemnification

You agree to indemnify and hold harmless Hooked on Yutz from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms within the App or on our website. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.
